Terms of Service
Effective and last updated: April 5, 2025
Welcome to Hostis. These Terms of Service (“Terms”) govern your access to and use of the Hostis platform and related services (collectively, the “Services”).
By creating an account or using the Services, you agree to be bound by these Terms. If you are using Hostis on behalf of a company or organization, you represent that you have authority to bind that entity and “you” refers to that entity.
1. Who we are
Hostis is operated by Hostis – Radivoje Đokić s.p., a sole proprietor established in Bosnia and Herzegovina, with registered address:
Crnjelovo Gornje
76300 Bijeljina
Bosnia and Herzegovina
2. What Hostis provides
Hostis is a unified platform-as-a-service (PaaS) and gaming panel that allows you to:
- • Deploy web apps, APIs, and static sites (for example via Git)
- • Run dedicated game servers (such as Minecraft, CS2, Rust, Valheim, ARK and others we may support)
- • Use managed databases, block storage, and S3-compatible object storage
- • Attach custom domains, use automatic SSL, preview URLs, and other deployment features
The exact features available to you may depend on your plan and current platform capabilities.
3. Your responsibilities
- Acceptable use: You must comply with our Acceptable Use Policy at all times. Using Hostis for illegal, abusive, or harmful activity is strictly prohibited.
- Account security: You are responsible for keeping your login credentials secure and for all activity that occurs under your account. If you suspect unauthorized access, you should notify us immediately.
- Content and code: You are solely responsible for the code, content, data, and configurations you deploy or host on Hostis, including compliance with all applicable laws (such as copyright, privacy, and consumer protection laws).
- Backups: You are responsible for maintaining your own backups of applications and data. While we may use backups internally for operational purposes, Hostis does not guarantee restoration of your data.
4. Accounts, plans, payments & billing
- • Some Services may be free or trial-based; others require a paid subscription or usage-based fees.
- • You agree to pay all applicable fees associated with your account, as displayed at the time of purchase or upgrade.
- • Taxes (such as VAT or similar) may be added where required by law.
- • Payments are processed via third-party payment providers (subprocessors) listed at hostis.cloud/legal/subprocessors.
- • Refunds are only available in limited cases described in our Refund Policy.
- • If payment fails or is overdue, we may suspend or restrict access to your Services. Long-term non-payment may result in termination and deletion of resources.
5. Data protection and privacy
Our collection and use of personal data is described in our Privacy Policy. When we process personal data on your behalf as a processor (for example, data about your own customers stored on Hostis), our Data Processing Addendum (DPA) applies.
By using the Services, you agree to these documents and confirm that you have the necessary rights and legal basis to process personal data through Hostis.
6. Intellectual property
- • You retain all rights to the code, content, and data you deploy or upload to Hostis.
- • By using the Services, you grant Hostis a worldwide, non-exclusive license to host, store, process, and transmit your content as necessary to operate the platform and provide the Services to you.
- • The Hostis platform itself, including its design, branding, software, and documentation, is owned by Hostis – Radivoje Đokić s.p. and/or its licensors and is protected by intellectual property laws. You may not copy, reverse engineer, or create derivative works of the platform, except as permitted by law.
7. Service availability and disclaimers
We aim to keep Hostis reliable and fast, but we do not guarantee uninterrupted availability. Maintenance, network issues, hardware failures, or incidents at upstream providers can cause downtime or degraded performance.
Unless explicitly stated in a separate, written Service Level Agreement (SLA) between you and Hostis, no formal SLA or uptime guarantee applies. Any service credits we may choose to offer (for example in case of a major incident) are discretionary and are not cash refunds.
Hostis is provided on an “as is” and “as available” basis. You are responsible for designing your applications and infrastructure (backups, redundancy, fallbacks) to tolerate failures.
8. Suspension and termination
We may suspend or terminate your access to all or part of the Services, with or without notice, if:
- • You violate these Terms or our Acceptable Use Policy
- • Your account is seriously overdue or unpaid
- • We detect security, abuse, or fraud risks related to your use of the Services
- • We are required to do so by law, regulation, or court order
You may close your account at any time via the dashboard or by contacting us. Closing your account does not entitle you to a refund for past charges unless explicitly agreed under our Refund Policy.
9. Limitation of liability
To the maximum extent permitted by applicable law:
- • Hostis and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, revenue, data, or goodwill), whether arising in contract, tort, or otherwise.
- • Hostis is not responsible for loss or corruption of your data, or for restoring data from backups. You are solely responsible for maintaining appropriate backups.
- • In any case, Hostis’s total aggregate liability arising out of or relating to the Services shall be limited to the amount you paid to Hostis for the Services during the twelve (12) months immediately preceding the event giving rise to the claim.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you via the dashboard and/or email. The updated Terms will become effective on the date specified in the notice. If you continue using the Services after the changes take effect, you are deemed to have accepted the updated Terms.
11. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of Bosnia and Herzegovina, without regard to its conflict of law rules.
Any disputes arising out of or in connection with these Terms or the Services shall be subject to the jurisdiction of the competent courts in or near Bijeljina, Bosnia and Herzegovina, unless mandatory law provides otherwise.
